Terms of Service

These Terms of Service ("Terms") govern your access to and use of Orosvera, including the mobile apps, backend services, training content, Adaptive Coach features, Community features, and related support services.

By creating an account or using Orosvera, you agree to these Terms and the Orosvera Privacy Policy. If you do not agree, do not use the app.

Eligibility

Orosvera is intended for adults 18 and older. You may not use Orosvera if you are under 18 or if you are legally prohibited from using the service.

You are responsible for making sure exercise is appropriate for you. If you have a medical condition, injury, health concern, or uncertainty about training safely, consult a qualified medical or fitness professional before using Orosvera.

Fitness Disclaimer And Assumption Of Risk

Orosvera provides fitness and training guidance. It does not provide medical advice, diagnosis, treatment, injury prevention, physical therapy, or emergency services.

Training involves risk. You are responsible for choosing exercises and loads you can perform safely, warming up, using appropriate technique, stopping or modifying any activity that causes pain or concern, seeking professional guidance when needed, and deciding whether to follow, edit, or ignore any app suggestion.

Coach proposes; you choose. Orosvera does not supervise your form, environment, equipment, or physical condition.

Your Account

You agree to provide accurate information and keep your account secure. You are responsible for activity under your account and for keeping your password private.

You may not sell, transfer, share, or misuse your account. We may suspend or terminate accounts that violate these Terms, threaten service security, harm other users, or violate law.

Adaptive Coach And Training Guidance

Adaptive Coach, Coach Style, Prime Today, Live Coach, Body Load, Balance Day, benchmarks, and recommendations are training-support tools. They rely on information you enter, such as workouts, sets, goals, closeout feedback, training profile details, and preferences.

Recommendations may be incomplete, inaccurate, unavailable, or inappropriate for your circumstances. You remain responsible for all training decisions. Orosvera does not guarantee results, progress, safety, injury prevention, or fitness outcomes.

User Content

You may create or submit content such as display names, goals, workout logs, notes, Custom Group names, custom programs, published programs, and group activity.

You retain ownership of your content. By submitting content to Orosvera, you grant us a non-exclusive, worldwide license to host, store, process, display, and transmit that content as needed to operate the service.

If you publish a program or make content visible to a Custom Group, you grant us permission to display that content to the intended audience. Published or shared content may remain with users who forked, copied, or interacted with it before removal where technically necessary.

Community And Custom Groups

Community and Custom Groups are intended for supportive accountability and shared momentum. You agree not to submit content or behavior that is harassing, hateful, discriminatory, threatening, sexual, violent, deceptive, illegal, or otherwise harmful.

You may not impersonate others, abuse invites, scrape other users' data, or use Community features for spam. Group admins may invite or remove members and disband groups. Orosvera may remove content, restrict accounts, or disable groups that violate these Terms.

Acceptable Use

You agree not to use the service for illegal activity, access accounts or systems without authorization, reverse-engineer the service except where law allows, probe or attack the service, submit harmful content, circumvent feature limits or entitlement checks, or use automated account creation or bulk data extraction.

Subscriptions, Beta Entitlements, And Purchases

Orosvera currently includes a beta entitlement framework. During beta, some or all users may receive full access to features that may later become paid features. StoreKit and Google Play Billing are not active unless expressly shown in the app and configured through Apple or Google.

If paid subscriptions are introduced later, pricing, renewal terms, cancellation, refunds, and payment handling will be shown before purchase and processed through Apple App Store or Google Play, as applicable. We will not charge you without purchase confirmation through the relevant store.

Beta access does not guarantee future free access to paid features.

Account Deletion And Termination

You can delete your account in the app: Settings -> Account -> Delete Account.

You can also request deletion at orosvera.com/account-deletion or by emailing privacy@orosvera.com.

We may suspend or terminate access if you violate these Terms, create risk for other users, misuse the service, or if continued operation is not commercially or technically feasible. Data deletion is handled as described in the Privacy Policy.

Intellectual Property

Orosvera's software, design, branding, copy, training systems, and service content are owned by or licensed to the Provider. You receive a limited, personal, non-transferable, revocable license to use Orosvera as intended.

These Terms do not grant ownership of Orosvera intellectual property, trademarks, source code, or backend systems.

Third-Party Services

Orosvera uses third-party services such as Firebase/Google, DigitalOcean, Cloudflare, Apple App Store, and Google Play. Their terms and policies may apply to your use of those services.

Service Availability

We aim to keep Orosvera available, but we do not guarantee uninterrupted service. Features may change, fail, or be discontinued. Sync, recommendations, community data, and backend access may be affected by outages, maintenance, network conditions, or provider issues.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND FITNESS OR HEALTH OUTCOMES.

Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST DATA, LOST PROFITS, PERSONAL INJURY, OR TRAINING OUTCOMES ARISING FROM USE OF OR INABILITY TO USE OROSVERA.

To the maximum extent permitted by law, total cumulative liability is limited to USD 100 or the amount you paid to Orosvera in the 12 months before the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so some limits may not apply.

Governing Law And Disputes

Until replaced, these Terms are drafted with Alabama, USA as the intended governing-law assumption. Disputes should first be raised informally by emailing support@orosvera.com.

Changes To These Terms

We may update these Terms when the app, business model, law, or service changes. Material changes will be communicated through the app or another reasonable method. Continued use after an update means you accept the updated Terms.
